What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants did not void the N4 notice by the required date. At the hearing, a payment plan was requested by the Tenant to preserve the tenancy, which the Board found reasonable and granted.

The ruling

The tenancy is not terminated. The Tenants are ordered to pay the Landlord $7,988.00 for rent arrears and costs through a 6-month payment plan. The Tenants must also pay their ongoing monthly rent on time. If they fail to comply with any payment terms, the Landlord can apply to the LTB for an ex-parte order to evict the Tenants and collect the outstanding balance.
