What happened
The Tenant filed an application alleging that the Landlords failed to meet maintenance obligations regarding heating, air quality, and hot water. The rental unit was located in a new residential complex still under construction. The Tenant claimed the heat was out for three weeks after moving in and that construction dust impacted air quality. The Landlords argued they responded promptly by providing space heaters and replacing air filters.
The ruling
The Tenant's application was dismissed in its entirety. The Board found that the Landlords met their maintenance obligations by responding reasonably and promptly to the Tenant's complaints, particularly considering the building was under construction. The Landlords' actions, including providing space heaters and replacing filters, were deemed sufficient under the Act.
