What happened
The Landlord applied for termination of the tenancy and eviction because the Tenant allegedly caused damage to the freezer and failed to pay water heater utility costs. The Tenant argued that the damage was due to the age of the appliance and that the Landlord was legally obligated to provide hot water services without additional fees. The Board found the Tenant partially responsible for the damage for failing to report it promptly and determined the Tenant was contractually obligated to pay for the water heater rental.
The ruling
The Landlord's application is granted in part. The tenancy is preserved on the condition that the Tenant pays the Landlord a total of $1,322.14. This amount includes $735.00 for water heater arrears, $401.14 for partial fridge replacement costs, and the $186.00 filing fee. Failure to pay by the specified date allows the Landlord to apply for an ex parte eviction order.
