What happened
The Landlord applied to terminate the tenancy after the Tenant breached conditions of a previous order (LTB-L-000161-25) regarding utility payments. An eviction order was issued without a hearing on July 9, 2025. The Tenant filed a motion to set aside that order, citing medical hospitalizations and a two-week lockout from the unit which impeded his ability to pay and manage his finances. The Tenant admitted to the breach but requested relief based on his circumstances.
The ruling
The LTB granted the Tenant's motion to set aside the eviction order. While the Tenant admitted to breaching the previous conditional order regarding utility payments, the Board found that his hospitalization and a two-week lockout warranted relief. The prior order was replaced with a new payment schedule requiring the Tenant to pay $2,338.63 in installments starting September 15, 2025. If any payment is missed, the Landlord may apply for eviction without further notice.
