What happened
The Tenant applied for an order against the Landlord for illegal entry, altering locks, interference, and harassment. The Landlord argued that the Residential Tenancies Act, 2006 did not apply, claiming it was a roommate situation where he also resided in the unit. The adjudicator found the Landlord's testimony not credible and ruled that the Act does apply. The ruling
The LTB ruled that the Residential Tenancies Act applies, rejecting the Landlord's claim of an exempt roommate situation due to a lack of credible evidence that he lived in the unit. Following this finding, the parties agreed to a consent order. The tenancy is terminated effective April 22, 2025. The Landlord is ordered to pay the Tenant $8,000.00 by June 13, 2025, and the Tenant is permitted to retrieve his belongings on a specified date.
