What happened

The Landlord obtained an ex parte eviction order after the Tenant breached a previous consent order regarding rent arrears. The Tenant filed a motion to set aside the eviction order, claiming they paid when they were able and that their income from abroad was delayed. The Landlord argued that the Tenant had repeatedly breached the payment plan and the consent order without valid justification.

The ruling

The Tenant's motion to set aside the eviction order is denied. The Member found the Tenant consistently breached a board-ordered payment plan and provided no credible excuse. The stay of eviction is lifted effective September 30, 2025, allowing the Landlord to enforce the eviction after that date.
