What happened
The Landlord applied to terminate the tenancy due to non-payment of rent, damages, and persistent late payment. At the hearing, the claims for damages and late payment were withdrawn, leaving only the non-payment issue. The Tenants argued they moved out in February 2025 because a broken glass wall made the unit uninhabitable. However, the Board found that the Tenants kept their belongings in the unit and did not return the keys until September 16, 2025, and that the unit remained habitable despite the repair delay.
The ruling
The tenancy is terminated effective September 16, 2025, the date the Tenants returned the keys. The Tenants are ordered to pay the Landlord $15,560.03 by December 9, 2025. This amount accounts for rent arrears until the move-out date and the filing fee, minus the rent deposit and accrued interest.
