What happened

The Tenants requested a review of an LTB order issued on January 15, 2026, which terminated their tenancy for non-payment of rent and other issues. The Tenants argued that they were not allowed to present evidence regarding alleged rent abatements and that an adjournment request to secure legal representation was unfairly denied. The Board found that the original member properly considered the evidence, noting that the Tenants' claim that the Landlord told them they no longer had to pay rent was unsupported by documentation. Furthermore, the Landlord's significant financial hardship, including filing a consumer proposal and the property being under power of sale, outweighed the Tenants' personal circumstances, which included caring for a child with autism.

The ruling

The request to review order LTB-L-101077-25 is denied. The original order issued on January 15, 2026, which presumably ordered eviction and payment of arrears, remains in full effect and is unchanged.
