What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to rent arrears. A key issue was whether a joint tenant, Tenant 2, was responsible for the full arrears or only her individual 'share' of the rent. The LTB also addressed the removal of a former occupant from the application who had vacated prior to the filing.
The ruling
The tenancy was terminated effective April 30, 2025, the date the Tenants vacated. The Tenants are ordered to pay the Landlord $6,262.82, representing rent arrears and the filing fee, less the rent deposit and interest. The Member rejected the argument that a joint tenant is only liable for a portion of the rent.
