What happened
The Landlord applied for the termination of the tenancy and eviction of the Tenant due to non-payment of rent. The Tenant attempted to raise maintenance and rights issues under Section 82 of the Act during the hearing but failed to properly serve the evidence to the Landlord, despite uploading it to the online portal multiple times. The Landlord sought a standard eviction order, citing financial prejudice and a failed attempt at a payment plan.
The ruling
The tenancy is terminated effective November 24, 2025. The Tenant is ordered to pay the Landlord $3,151.14 for rent arrears and the application fee. The Tenant may void the eviction by paying a total of $3,936.00 (which includes rent for the upcoming period) on or before November 24, 2025. If the Tenant does not pay or vacate, the Landlord may file with the Sheriff for enforcement on November 25, 2025.
