What happened
The Tenant requested a review of an eviction order issued for non-payment of rent, claiming she never received the hearing notice or the final order. The Tenant asserted that her nanny misplaced the mail and that she was suffering from medical issues (Adenomyosis, ADHD, and PTSD) that impaired her ability to manage household communications. The Landlord provided evidence that the N4 notice and a rent update were served under the Tenant's door, and the LTB records showed no mail was returned as undeliverable. The Adjudicator found the Tenant lacked due diligence and that her testimony was self-contradictory.
The ruling
The request to review the eviction order is denied. The original order issued on February 18, 2025, remains in effect, and the stay of that order is lifted. The Tenant's eviction, which was previously enforced by the Sheriff, is confirmed.
