What happened

The Landlord applied to evict the Tenant for non-payment of rent. The Tenant argued he was not responsible for the arrears because the Landlord interfered with his attempt to sublet the unit to a friend while he was away in Pakistan due to a family emergency. The member found the Tenant remained liable for the rent regardless of the sublet situation, as the sublet issue is part of a separate tenant application and does not negate the rent obligation.

The ruling

The tenancy is terminated unless the Tenant pays $15,932.32 by June 30, 2025. If the Tenant fails to pay, they must vacate by June 30, 2025, and pay the Landlord $10,623.15 plus daily compensation of $64.71 from May 9, 2025, until they move out. The Tenant's arguments regarding a sublet were deferred to a separate application. Eviction was delayed to June 30, 2025, considering the Tenant's personal difficulties.
