What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Tenants are joint tenants and did not void the N4 notice by paying the arrears.
The ruling
The application is stayed until the earlier of: (a) the restrictions imposed by sections 69.2 and 66.34 of the BIA ceasing to apply; or (b) an order being made by the Ontario Superior Court of Justice permitting the application to proceed. The Tenants must pay rent from 2023-12-20 onwards, and the Landlords can pursue Mr. Bernal for rent owed as of 2023-12-19 via an L9 application.
