What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Landlord served a valid N4 Notice, and the Tenants did not void the notice by paying the rent arrears.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenants pay $120 per month towards the arrears from May 2023 to January 2024, and the remaining $53 by February 1, 2024. The Tenants must also pay the monthly rent in full and on time during this period. If the Tenants fail to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenants.
