What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had remained in possession of the rental unit at the time of the hearing.

The ruling

The Tenant's request for review was granted. A de novo hearing was ordered. The Landlord's application to terminate the tenancy and evict the Tenants for non-payment of rent was granted. The Tenants were given until October 31, 2024 to void the order by paying the outstanding rent arrears of $8,279.80 or $10,328.09 if paid by October 31, 2024. If the Tenants do not pay the required amount, the tenancy will be terminated and the Landlord may enforce the eviction.
