What happened
The Landlord initially applied to determine if the Residential Tenancies Act (RTA) applies, while the Tenant applied alleging an illegal lockout and harassment. An order issued on February 13, 2025, found the RTA does not apply because the Tenant shared a kitchen with the Landlord, exempting the tenancy under section 5(i). The Tenant requested a review of this decision, claiming they were unable to participate in the hearing and that there was a serious error. This review order denies the Tenant's request, confirming the original finding and order.
The ruling
The Tenant's request to review the order issued on February 13, 2025, is denied. The original order, which determined that the Residential Tenancies Act, 2006 does not apply to this tenancy due to a shared kitchen, is confirmed and remains in full effect.
