What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant admitted to the debt and requested a repayment plan. However, the Adjudicator determined that the proposed plan was not viable based on the Tenant's financial breakdown, as the combined rent and arrears payments would consume nearly all of the Tenant's income, leaving insufficient funds for regular living expenses. Consequently, the Landlord's request for a standard voidable eviction order was granted.

The ruling

The tenancy is terminated effective August 2, 2025, unless the Tenant voids the order by paying the full amount of arrears and fees. If the payment of $8,243.96 is made by July 31, 2025 (or $9,481.96 by August 2, 2025), the tenancy continues. If the Tenant does not void the order, they must vacate by August 2, 2025, and pay the Landlord $5,554.71 plus daily compensation of $40.70 until they move out.
