What happened

The Tenant applied for an order after a fire occurred in the rental unit on June 3, 2025. The Tenant alleged that the Landlord altered the locking system without providing keys and harassed or interfered with the Tenant. The main legal issue was whether the fire had frustrated the tenancy agreement, thereby ending the tenancy, or if the Tenant had a right to return to the unit once repairs were completed. The Tenant also sought compensation for lost belongings.

The ruling

The Landlord is ordered to pay the Tenant $48.00 for the application filing fee. The Board ruled that the tenancy was not frustrated by the fire. The Landlord must allow the Tenant to recover possession of the rental unit and provide keys as soon as the unit is safe to occupy. The Landlord is expressly prohibited from re-renting the unit to anyone else.
