What happened

The Landlord applied to terminate the tenancy because the Tenant transferred occupancy to an unauthorized occupant without consent. The Tenant had moved out in 2014, leaving another individual in the unit, then briefly returned in 2024 before leaving again. The Tenant attempted to end the tenancy through N11 and N15 notices while intending for the occupant to remain. The Landlord sought eviction of the occupant and compensation for use of the unit.

The ruling

The tenancy is terminated due to unauthorized occupancy transfer. The Unauthorized Occupant is ordered to vacate the unit by November 30, 2025. The Unauthorized Occupant must pay the Landlord $10,144.37, which includes daily compensation for the use of the unit and the filing fee, after deducting the rent deposit and interest.
