What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. Tenant 1 attended the hearing and requested an adjournment to wait for a housing subsidy from Hamilton Housing. The Landlord opposed the adjournment and any further payment plan, citing a previous breached agreement. Tenant 1 also noted he had been working part-time due to a back injury but recently returned to full-time work.
The ruling
The tenancy is terminated effective September 30, 2025, unless the Tenants pay $7,379.00 by August 31, 2025, or $8,506.00 by September 30, 2025, to void the order. If the Tenants do not void the order, they must vacate by September 30, 2025, and pay the Landlord $5,234.30 plus daily compensation of $37.05 from July 24, 2025.
