What happened

Tenants applied for judicial review of a 2012 Landlord and Tenant Board decision and 2013 reconsideration decision, more than 6 years after the appeal deadline. The court dismissed the application as the tenants failed to exhaust their appeal rights under the Residential Tenancies Act.

The ruling

The court dismissed the tenants' application for judicial review without prejudice to their right to bring a motion to extend the time to appeal under section 210 of the Residential Tenancies Act. The court noted that it was likely too late for such an appeal, but the tenants could present their explanation for the delay if they chose to pursue that option.
