What happened

Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenants with an N12 notice to terminate the tenancy for personal use, and the Tenants vacated the rental unit. However, the Landlord later advertised the rental unit for rent and entered into a new tenancy agreement with someone else.

The ruling

The Tenants proved the allegations contained in the application on a balance of probabilities. The Landlord must pay the Tenants a total of $9,634.60, which represents a rent abatement, rent differential, and general compensation.
