What happened

The Tenant filed an application alleging the Landlord illegally changed the locks, entered the unit without notice, and substantially interfered with reasonable enjoyment. The Tenant was locked out after returning from a hospital stay, resulting in homelessness and seeking shelter in subway stations. Despite an interim order for restoration of possession, the Landlord made the unit uninhabitable by removing an interior door, cutting power to the refrigerator, and tampering with the furnace controls.

The ruling

The Landlord is ordered to pay the Tenant a total of $12,947.22, which includes $10,000.00 in general damages for an illegal lockout that led to the Tenant's homelessness. Additionally, the Landlord must return all Tenant property by May 31, 2025, or pay an extra $600.00. An administrative fine of $1,000.00 is payable by the Landlord to the LTB for blatant disregard of the Residential Tenancies Act.
