What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent and NSF cheque charges. The Tenant did not attend the hearing despite being served with notice. Although the Tenant made a significant payment of $6,215.97 after the application was filed, arrears remained outstanding. The Landlord sought the remaining balance and eviction.
The ruling
The tenancy is terminated unless the Tenant pays $2,827.20 by July 29, 2025, to void the order. If the Tenant fails to pay and the tenancy is terminated, they are ordered to pay the Landlord $117.74 (representing arrears up to the hearing date plus filing fees and NSF charges, less the rent deposit and interest) plus $48.50 daily compensation from July 4, 2025, until they vacate.
