What happened
The Landlord applied to terminate the tenancy under Section 78 after the Tenants breached a condition of a previous LTB order (issued June 23, 2025) which required an arrears payment of $2,000.00 by July 25, 2025. The Tenants failed to pay the full arrears and also missed the August 2025 rent payment. Tenant 1 admitted to the non-payment but cited maintenance issues, for which she has filed a T6 application. Tenant 2 claimed he moved out in late 2024 and is only responsible for arrears, not ongoing rent. The Landlord testified that the missing rent is causing severe financial hardship, putting her property at risk of foreclosure.
The ruling
The Tenants' motion to set aside the eviction order (LTB-L-064665-25) is denied. The stay of that order is lifted effective October 21, 2025, allowing the Landlord to proceed with eviction due to the Tenants' failure to meet the payment conditions of a previous order and ongoing rent obligations.
