What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent and persistent late payment of rent. The Landlords served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears. The Tenants did not attend the hearing.

The ruling

The L2 application for persistent late payment is dismissed. The tenancy is terminated unless the Tenants pay $20,586 by March 23, 2024 to void the order. If the Tenants do not pay, they must vacate by March 23, 2024 and pay the Landlords $14,565.43 plus daily compensation.
