What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. As of the hearing date, the Tenants remained in possession of the unit with no payments made since the application was filed. Tenant 2 testified to severe financial and medical hardships, requesting a postponement of the eviction. The Landlord argued that further delays would cause significant financial prejudice as they rely on the rent to cover property expenses. The Board found the arrears to be substantial but granted a short postponement of the eviction until August 31, 2025, considering the Tenant's health issues and the size of the rent deposit held.
The ruling
The tenancy is terminated effective August 31, 2025, unless the Tenants void the order by paying $22,986.00 by August 1, 2025, or $26,786.00 by August 31, 2025. If the Tenants do not void the order, they must vacate by August 31, 2025, and are ordered to pay the Landlord $11,568.30 (representing arrears minus the rent deposit and interest) plus daily compensation of $124.93 until they vacate.
