What happened

The Landlord applied for an order to terminate the tenancy based on an N11 agreement. An ex-parte order was initially issued. During a subsequent hearing for damages (L10 application), questions arose regarding the actual termination date because the Tenants left an unauthorized occupant (Tenant 2's son) in the unit after they physically moved out. The Board initiated a review (BIR) to determine if the original termination order contained an error regarding the date and possession.

The ruling

The Board-initiated review of the original termination order is denied. The original order issued on April 18, 2023, which terminated the tenancy effective April 29, 2023, remains in full force and effect. The stay of that order is lifted. The Board found that the Tenants did not provide vacant possession because they left an unauthorized occupant in the unit, meaning the tenancy did not terminate on the N11 date.
