What happened

The Landlord applied for eviction and rent arrears. The Tenants attempted to raise maintenance issues under Section 82, but were barred due to late disclosure and failure to follow the 7-day rule. The Tenants requested an adjournment which was denied. The Tenants argued they were in a financial crisis, receiving only Ontario Works, and claimed the unit had rodents and mold from a previous illegal grow-op, though no evidence was provided.

The ruling

The tenancy is terminated effective November 30, 2025, unless the Tenants void the order by paying the full arrears. The Tenants are ordered to pay the Landlord $25,084.09 for arrears up to the hearing date plus the filing fee, after deducting the rent deposit and interest. Eviction is postponed to late November due to the Tenants' financial hardship and reliance on social assistance.
