What happened
The Landlord applied for an ex-parte eviction order after the Tenant allegedly breached a condition of a previous LTB order dated June 16, 2025, by failing to pay rent arrears of $808.29. The Tenant filed a motion to set aside the resulting eviction order, arguing that the Landlord failed to provide a required rent summary as agreed in the initial order, leaving the Tenant unaware of the basis for the arrears amount. The Landlord admitted the summary was provided only after the breach and filing for eviction.
The ruling
The LTB granted the Tenant's motion to set aside the eviction order (issued August 25, 2025). The ex-parte order is now unenforceable. The adjudicator established a new payment plan for the remaining $488.29 in arrears, to be paid in two installments on October 1 and November 1, 2025. If the Tenant fails to make these payments or pay future rent on time, the Landlord may re-apply for eviction under Section 78.
