What happened
The landlord applied to the Landlord and Tenant Board for a determination that the tenant had transferred her tenancy to an unauthorized occupant without the landlord's consent. The Board ruled in favor of the landlord, terminating the tenancy and ordering the unauthorized occupant to vacate. The unauthorized occupant appealed the Board's decision to the Divisional Court.
The ruling
The Divisional Court dismissed the appeal of the Landlord and Tenant Board's decision, which had determined that the appellant was an unauthorized occupant and terminated the tenancy. The court found no errors of law in the Board's decision and rejected all grounds of appeal raised by the appellant.
