What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant, a 60-year-old long-term resident of 31 years, admitted to the arrears but proposed an unreasonable repayment plan. The Tenant also requested an adjournment to file evidence, which was denied. The Board granted the eviction but provided a significant postponement of the enforcement date under Section 83 of the Act due to the Tenant's age and personal circumstances.

The ruling

The tenancy is terminated effective October 15, 2025, unless the Tenant voids the order by paying the specified arrears and subsequent rent. The Tenant is ordered to pay $4,365.40 representing arrears up to the hearing date plus filing fees. Due to the Tenant's age, 31-year tenure, and family health issues, the Board exercised discretion to delay eviction enforcement until mid-October 2025.
