What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. While the Tenants had made a large payment of over $20,000 since the application was filed, a balance of over $25,000 remained. Tenant 1 admitted to having substantial savings but preferred to keep the savings and pay the landlord over a two-year period rather than settling the debt immediately.
The ruling
The tenancy is terminated effective September 16, 2025, unless the Tenants pay $25,940.00 to void the order. The Board denied the Tenant's request for a long-term payment plan because the Tenant admitted to having $180,000.00 in savings, making it unfair to deny the Landlord immediate payment. If the Tenants do not pay and do not vacate, the Landlord may enforce the eviction through the Sheriff on or after September 17, 2025.
