What happened
The landlord filed an application to terminate the tenancy and evict the tenant due to non-payment of rent. The matter was previously settled by a consent order (TNL-368801-22) which required the tenant to pay the outstanding arrears by a certain date. The landlord alleges the tenant breached the consent order by failing to make the required payment, and the landlord was granted an ex-parte order to terminate the tenancy. The tenant filed a motion to set aside the termination order.
The ruling
The motion to set aside the previous termination order (LTB-L-018621-23) is denied. The stay of the termination order is lifted on August 31, 2023, to give the tenant time to find a new place to live.
