What happened

The Landlord applied for an order to terminate the tenancy and evict the Unauthorized Occupant because the Tenant passed away and occupancy was transferred to the Tenant's child without the Landlord's consent. The Landlord, being a social housing provider, sought to recover possession and compensation for the period the Unauthorized Occupant remained in the unit after the Tenant's death.

The ruling

The tenancy is terminated. The Unauthorized Occupant is ordered to move out by October 21, 2025. The Occupant must pay the Landlord $1,176.52 for daily compensation from March 1 to September 24, 2025, plus a daily rate of $44.94 until they vacate, and the $201.00 filing fee. If the unit is not vacated, the Landlord may enforce the eviction through the Sheriff.
