What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Ashe-Lee Mayer was still in possession of the rental unit at the time of the hearing, while the other tenant Matt Grandbois had vacated the unit.

The ruling

The tenancy is terminated unless the tenants pay $16,322 to void the order by September 16, 2023. If the tenants do not pay, they must vacate the unit by September 16, 2023 and pay the landlord $10,834.15, plus daily compensation of $46.98 from July 6, 2023 until the date they move out.
