What happened
Tenant 1 filed an application against the Landlord alleging illegal entry, harassment, and interference with enjoyment. The Landlord challenged Tenant 1's status as a legal tenant, asserting he was merely an occupant/roommate of Tenant 2. The LTB held a review hearing to determine the merits of the application and the preliminary issue of Tenant 1's status.
The ruling
The LTB dismissed the T2 application filed by Tony Thibault. The Board found that Thibault was not a legal tenant but a roommate/occupant, as he paid rent to the primary tenant rather than the landlord. Because an occupant cannot file a T2 application, the matter was dismissed. A late request to add the legal tenant to the application was also denied.
