What happened
The Landlord applied for a declaration to determine whether the Residential Tenancies Act, 2006 applies to the tenancy. The Landlord contended that because the Tenant had allegedly given verbal notice to terminate and surrendered possession of the premises, the Act should not apply. The Tenant was briefly present at the virtual hearing but disconnected before the case was called, and the matter proceeded in the Tenant's absence.
The ruling
The Landlord and Tenant Board determined that the Residential Tenancies Act, 2006 applies to the tenancy between The Hazel Project Limited and the Tenant. The Landlord's request for a declaration that the Act does not apply was denied.
