What happened
The Tenant requested a review of a previous LTB order that terminated the tenancy for the Landlord's own use. The Tenant alleged procedural unfairness, claiming they were prevented from playing a video that supposedly proved the Landlord's true motivation was to sell the property rather than occupy it. The Board reviewed the request and determined that because the Tenant failed to upload or serve the video evidence in advance of the original hearing, the exclusion of the video was not a serious error.
The ruling
The request to review the order issued on August 8, 2025, is denied. The original order, which terminated the tenancy effective August 31, 2025, for the Landlord's own use, remains in full force and effect. The Board found no serious error in the exclusion of the Tenant's late evidence or the Member's determination of good faith.
