What happened

The Landlord applied for termination of the tenancy and an order for unpaid utility expenses. The Landlord alleged that the Tenants' failure to pay utilities (water, gas, electricity, and hot water tank rentals) constituted substantial interference with the Landlord's lawful rights. The Tenants admitted to the arrears but cited financial hardship and emotional turmoil following a death in the family, while also noting issues accessing online billing and receiving physical bills addressed to the Landlord.

The ruling

The LTB ordered the Tenants to pay $16,759.68 for unpaid utilities and the filing fee. Eviction was stayed (relief granted) on the condition that the Tenants adhere to a strict payment plan starting January 2026 and ending November 2028. If the Tenants miss a payment, the Landlord may apply for an ex parte eviction order under section 78.
