What happened
Applicants alleged that the City harassed and interfered with them by refusing to provide a lease and attempting to have them trespassed from a property they had occupied and renovated. The Applicants claimed an implied tenancy, while the City argued that no tenancy agreement was ever formed.
The ruling
The application was dismissed because the Applicants were found not to be tenants under the Residential Tenancies Act. The Board ruled that no tenancy agreement existed as the City never agreed to lease the property to the Applicants. Consequently, the LTB lacks jurisdiction to hear the harassment application.
