What happened
Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords served the Tenants with an N12 notice to terminate the tenancy for personal use, and the Tenants vacated the rental unit as a result. The Landlords then listed the rental unit for sale shortly after the Tenants vacated.
The ruling
The Tenants' application is granted. The Landlords must pay the Tenants $12,300 for the increased rent they have paid for one year, and $6,000 in general compensation, for a total of $18,353. The Landlords did not prove the N12 notice was served in good faith.
