What happened
The Tenants filed a motion to set aside an eviction order that was issued after they breached a condition of a previous LTB order by failing to pay $100.00 toward rent arrears. The Tenants argued that their income was disrupted due to paperwork issues with CPP and cited significant health problems requiring surgery. The Landlords opposed the motion, noting that arrears had grown to $8,700.00 and no payments had been received for months.
The ruling
The Tenants' motion to set aside the eviction order is denied. The original eviction order issued on December 1, 2025, remains in effect; however, the stay on that order is lifted effective February 15, 2026, providing the Tenants extra time to vacate due to health issues and the need to relocate four adults.
