What happened

The Tenants filed an application alleging that the Landlord substantially interfered with their reasonable enjoyment of the rental unit due to a cockroach infestation. Tenant 1 and Tenant 2 claimed that the Landlord was aware of the infestation before the tenancy began and failed to disclose it or adequately treat the problem. The Landlord countered that they had no knowledge of a prior issue, the unit was renovated before move-in, and they responded promptly with professional pest control treatments whenever a complaint was made.

The ruling

The Tenants' application was dismissed. The Board found that the Landlord acted reasonably in addressing the pest issues reported and that there was no evidence of negligence or bad faith disclosure regarding the condition of the unit prior to the tenancy.
