What happened
The Landlord applied for the termination of the tenancy and eviction of the Tenant due to non-payment of rent. A significant point of contention involved the lawful rent amount, which the Tenant argued was reduced after his girlfriend moved out. The Landlord had originally named the girlfriend as a respondent, but she was removed as she had already vacated. The Tenant provided text evidence confirming a rent reduction agreement.
The ruling
The tenancy is terminated effective September 1, 2025, unless the Tenant voids the order by paying the total arrears. To void the order by August 31, 2025, the Tenant must pay $11,786.00. If the Tenant does not void the order, he is ordered to pay the Landlord $7,262.15 for arrears up to the hearing date plus daily compensation of $39.45 until he vacates. The lawful rent was adjusted to $1,200.00 per month.
