What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Tenant requested an adjournment to have her maintenance issues heard together, but the Board denied the request. The Tenant has been persistently late in paying rent, with 20 late payments in the past 21 months. The Tenant claimed the late payments were due to maintenance issues, but the Board found the Tenant did not prove this.
The ruling
The tenancy is terminated effective January 2, 2024. The Tenant must pay the Landlord $6,262.15, which includes rent arrears, compensation for use of the unit, and the application filing fee, less the rent deposit and interest. If the Tenant does not pay by November 18, 2023, interest will accrue on the outstanding balance.
