What happened
The landlord applied for an order to terminate the tenancy and evict the tenants because the tenants entered into an N11 agreement to terminate the tenancy. The tenants filed a motion to set aside the eviction order, arguing that the N11 was signed with the understanding that a new lease would be signed with a new tenant, which did not happen.
The ruling
The Board denied the tenant's motion to set aside the eviction order, but granted a short delay in lifting the stay of the order until September 30, 2023.
