What happened
The Landlord filed applications for non-payment of rent (L1) and persistent late payment of rent (L2). This order also addresses a Board-initiated review of a previous order from February 2025, which was found to contain a serious error and was subsequently cancelled. The Tenants had undisputed rent arrears and a history of paying rent late 10 times in a 12-month period. Despite concerns about the credibility of Tenant 1's testimony, the Board granted the Tenants relief from eviction with strict conditions to repay the arrears and maintain timely rent payments for 12 months.
The ruling
The tenancy is terminated unless the Tenants pay the Landlord $9,486.00 by June 15, 2025, or $11,036.00 by July 15, 2025. If they fail to pay, they must vacate by July 15, 2025, and will owe the Landlord $5,445.61 plus daily compensation. If the Tenants do pay and void the order, they must then pay rent in full and on time from August 2025 to July 2026. Failure to comply with this condition allows the Landlord to apply for eviction without notice.
