What happened

The Landlord applied for an order to terminate the tenancy because the Tenant breached a condition of a previous LTB order dated May 20, 2025, which required her to keep her dog muzzled in common areas. An ex parte order was issued on June 20, 2025, terminating the tenancy. The Tenant filed a motion to set aside that order, claiming she lost the dog's muzzle at a park and could not replace it immediately. The Member found the Tenant's explanations lacked credibility and demonstrated a disregard for the safety of other residents.

The ruling

The Tenant's motion to set aside the eviction order is denied. The stay of the eviction order is lifted effective September 30, 2025. The Member granted the Tenant extra time to vacate given her vulnerability and the landlord's status as a supportive housing provider, to help her avoid homelessness.
