What happened

The Landlord applied for an eviction order (L3) based on an N11 agreement signed only by Tenant 1. Tenant 2, who is also on the lease, did not sign the agreement and did not authorize anyone to sign for him. An initial order was issued without a hearing, which the Tenants subsequently moved to set aside.

The ruling

The LTB granted the Tenants' motion to set aside the previous eviction order. The original order issued on August 25, 2025, is cancelled and unenforceable because the underlying N11 Agreement was invalid. The Landlord's application to terminate the tenancy is dismissed.
